We know your personal information is important to you and it is also important to Exaktera LLC. “Exaktera,” “we,” “our” and “us” refer to Exaktera LLC and any of our subsidiaries and corporate affiliates.
This Privacy Statement applies to your use of www.Exaktera.com (“Our Site”) and tells you what personal information we collect about you and explains your rights around how we use it. Please read this Privacy Statement to understand how and why we use your personal information when you use Our Site. If you do not agree with the personal data practices described in this Privacy Statement, please do not use Our Site. Your use of Our Site constitutes your agreement with the terms of this Privacy Statement. Please review Our Site’s Terms of Use, which also governs your use of Our Site.
The terms “you” and “your” refers to visitors to Our Site.
Who Controls Your Information
For the purposes of applicable data protection legislation, Exaktera is the data controller. You will find our contact details in the “Contact us” section below.
Information We May Collect and Process
We may collect and process the following categories of data:
Information you give us
We receive and store information you enter on Our Site or you give us in any other way when you fill in an online form, check product availability or download a brochure. This includes but may not be limited to:
- Name
- Email address
- Phone numbers
- Fax number
- Company name
- Credit Card
- Creditworthiness, VAT number, product, purchase information history, request documentation
- Resume or CV, including work history, professional qualifications, publications, awards, references, completed training and signature
- Pictures, video and audio recordings where you have provided your permission
- Postal code, state, and country
Information we collect about you
Even if you do not directly provide us with information, we may collect certain personal information when you interact with Our Site. Personal information may be stored or accessed using a variety of technologies that may be downloaded to your personal computer, browser, laptop, tablet, mobile phone or other device whenever you visit or interact with Our Site. For example, our servers may keep an activity log that tracks all visitors to Our Site. The information in the activity log may be anonymous and therefore may not identify you individually, however such information, in conjunction with other information that we hold, may also be capable of identifying you and so may constitute personal data within the meaning of personal data legislation. Information we receive from other sources
We work closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, and search information providers) and may receive information about you from them. This includes but may not be limited to:

- e-mail address
- phone number
- other contact information
To the extent we combine information we receive from those sources with your personal information we collect on Our Site, we will treat it as personal information and we will apply this Privacy Statement to such combined information. In no other circumstances do our statements under this Privacy Statement apply to information we receive about you from third parties. By your use of Our Site, you acknowledge and agree that information collected about you by third parties is subject to such third parties’ privacy policies, over which we have no control.

We may combine this information with information you give to us and information we collect about you. We may use this information and the combined information for the purposes set out above (depending on the types of information we receive).

We use your personal information to comply with law and regulations. For example:
- keeping proper books and records
- audit purposes
- to comply with any other legal obligations to which we are subject, including, but not limited to subpoenas

Marketing Communications
- We may send you marketing communications, including emails about our products, services, and promotions, in the following circumstances:
- If you have opted in to receive marketing communications from us, we will send you marketing communications until you withdraw that consent, or
- If the requirements of Article 13(2) of the ePrivacy Directive are satisfied such that the “soft opt-in” exception applies. Under Article 13(2) of the ePrivacy Directive, if you purchased a product or service from us and provided us with your contact details, we may send you marketing communications about our own similar products and services, even if you have not separately opted in. We will only use this exception where:
- you provided your details to us during a sale of a product or service;
- the marketing relates only to our own similar products or services;
- you were given a clear opportunity to opt out of marketing at the time we collected your details, and did not do so; and
- you are given a simple way to opt out in every marketing message we send you, such as by clicking the “unsubscribe” link at the bottom of the email.
- You can opt out of receiving marketing communications from us at any time.
Who We Share Your Personal Information With
Exaktera will not sell, rent, or lease your personal information with third parties. We may share your personal information with third parties, subject to this Privacy Statement.
We may disclose your personal information to our affiliates for the administration and management of our business and compliance with applicable laws rules and regulations, and internal policies and procedures across the Exaktera Group (including statutory reporting and disclosures to regulatory authorities). This is under close instruction from us, including policies and procedures designed to protect your information. We require that any third parties to whom we do provide your personal information in compliance with this Privacy Statement have privacy policies of their own which they can provide to us upon request.
Governmental, regulatory, etc.
We may disclose your personal information to a governmental or regulatory body (including tax authorities, law enforcement agencies, and financial regulators) in order to comply with a legal obligation or to any person pursuant to an order of a court or regulatory agency of competent jurisdiction.
Professional Advisors and Experts
We may also disclose your information to our attorneys, solicitors, auditors, insurance advisors and financial services advisors.
We may share your information with selected third parties including:
- Business partners, suppliers, and sub-contractors for the performance of any contract we enter with them or you (for example, professional advisors, IT systems providers and communications providers, marketing services providers)
- Advertisers and advertising networks that require the data to select and serve relevant advertisements to you and others in order to conduct our advertising
- Analytics and search engine providers that assist us in the improvement and optimisation of our products or services
We may disclose your personal information to third parties:
- If we sell any business or assets, in which case we may disclose your personal data to the prospective buyer of such business or assets, subject to a confidentiality and non-disclosure agreement which would require them to abide by this Privacy Statement with respect to your information prior to the completion of the sale
- If Exaktera or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers may be one of the transferred assets
- If we are under a duty to disclose or share your personal data to comply with any legal obligation and agreements; or to protect the rights, property, or safety of Exaktera, its customers, or others
- Where the data consists of aggregated user statistics and browsing behaviour information, and not personal information
- As disclosed at the time you provide the information and as described below or otherwise in this Privacy Statement
We are not responsible for third-party technologies or activities arising out of them, nor are we responsible for the effectiveness of or compliance with any third parties’ opt-out options.
Third-Party Content or Links to Third-Party Sites
Our Site may contain content that is supplied by third parties, and those third parties may collect information when pages from Our Site are served to you. In addition, when you are on Our Site you may be directed to other services that are operated and controlled by third parties that we do not control. We are not responsible for the data collection and privacy practices employed by any of these third parties or their services, and they may be tracking you across multiple sites and may be sharing the results of that tracking with us and/or others. For example, if you “click” on a link, the “click” may take you off Our Site onto a different site. These other sites may associate their tracking technologies with you, independently collect data about you or others, including personal information, and may or may not have their own published privacy policies. We encourage you to note when you leave Our Site and to review the third-party privacy policies of all third-party websites and exercise caution in connection with them.
Data Retention Periods
It is our aim to only hold your data for as long as this is necessary.
How long Exaktera will hold your personal data for will vary and will be determined by the following criteria:
- the purpose for which Exaktera is using it: Exaktera will need to keep the data for as long as is necessary for that purpose
- legal obligations: laws or regulation may set a minimum period for which Exaktera has to keep your personal data
- when and if you contact us by the means provided below and request that we discontinue storing, using and/or processing your personal data
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, accounting, or reporting requirements.
In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you. If, however, the anonymised data can reasonably be reassociated with you, then it shall be treated as personal data subject to the other terms of this Privacy Statement.
Security
We are committed to protecting the security of your personal data. We use a variety of security technologies and procedures to help protect your personal data from unauthorised access and use. Any area of our site that is used to capture your personal information or payment details will always be in a secure session using 128-bit Secure Socket Layer (SSL) encryption, which is the industry standard.
As effective as modern security practices are, no physical or electronic security system is entirely secure. The transmission of information via the internet is also not completely secure. We cannot guarantee the complete security of our databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the internet. We will continue to revise policies and implement additional security features as new technologies become available. Exaktera evaluates these safeguards on an ongoing basis to help minimise risks from new security threats as they become known.
Although we will do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted to us. Any transmission of data is at your own risk. Once we receive your personal data, we use appropriate security measures to seek to prevent unauthorised access.
Should we become aware of an actual or suspected breach of security which has or is reasonably believed to have involved access to or compromise of personal data, we will follow all applicable laws and regulations regarding notifications to you, government authorities, and others.
Transfers of Your Information Outside of the United States
We store your information in different locations. Electronic files are stored on our secure servers in Germany, Ireland, the United Kingdom, the United States of America or in the cloud.
We use cloud solutions for web hosting or proprietary software solutions delivered through the Cloud. Our use of servers and cloud solutions may involve transferring your information outside of the European Economic Area (“EEA”).
We may in some circumstances need to transfer your information to our other offices or agents and contractors located outside the European Economic Area.
Where we transfer your personal data outside the EEA, we will ensure that it is protected in a manner that is consistent with how your personal data will be protected by Exaktera in the EEA. Under applicable data protection legislation, this can be done in several ways, for instance:
- the country that Exaktera sends the data to might be approved by the European Commission as offering an adequate level of protection for personal data;
- the recipient might have signed up to a contract based on “model contractual clauses” approved by the European Commission, obliging them to protect your personal data; or
- where the recipient is in the US, it might be a certified member of the EU-US Data Privacy Framework.
In other circumstances, the law may permit Exaktera to otherwise transfer your personal data outside the EEA. In all cases, Exaktera will ensure that any transfer of your personal data is done in accordance with data protection law.
You can obtain more details of the protection given to your personal data if it is transferred outside the EEA (including a copy of the standard data protection clauses which Exaktera has entered with recipients of your personal data) by contacting us as described below.
Opting Out of Targeted Advertisements
You may revoke your consent to targeted advertising at any time with effect for the future by:

- filling out a form by clicking on the “Your Privacy Choices” link at the bottom of Our Site
What Should Parents Know About Children?
We understand the importance of protecting children’s privacy in the interactive world. Our Site is not intended for use by children. We do not use Our Site to knowingly collect personal information from children under the age of thirteen (13).
If we become aware that we have collected personal information from any child, we will dispose of that information in accordance with Children’s Online Privacy Protection Act (“COPPA”) and other applicable laws and regulations. If you are a parent or guardian and you believe that your child under the age of 13 has provided us with personal information without COPPA-required consent, please contact us at privacy@exaktera.com. We also do not knowingly sell or share personal information about consumers under the age of 18. If we are made aware that we have been provided personal information from or about someone who is under the age of 18, we will delete that information and cease using it for any and all purposes and take reasonable steps to notify any third parties to whom we have provided such personal information that they must also delete it and cease using it for any and all purposes.
Changes to This Privacy Statement
We reserve the right to change this Privacy Statement from time to time at our sole discretion. If we make any changes, we will publish those changes on Our Site. At the bottom of this Privacy Statement, you will find the date on which this Privacy Statement was last updated. To the extent any provision of this Privacy Statement is found by a court of competent jurisdiction to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.

Your E.U. Rights

Where we process your data solely based on your consent, you are entitled to withdraw your consent at any time. This will not affect the lawfulness of our processing before the withdrawal.

If you are submitting a rights request as an authorised agent, we may require you to submit proof of your authorisation to make the request, such as valid power of attorney or proof that you have signed permission from the individual who is the subject of the request. Please do not provide any sensitive personal information in connection with this request, such as a copy of or the number of a driver’s licence or other government-issued ID. Right to Appeal
If you are a resident of any state that grants you any of the above data access or opt-out rights, you or a person purporting to act on your behalf make a request to exercise any of the rights explained above, and we are unable to comply with your request, you may appeal our decision. California Shine the Light
California law permits residents of California to request certain details about how their information is disclosed to third parties for direct marketing purposes. Under the law, a business must either provide this information or permit California residents to opt in to, or opt out of, this type of disclosure. Additional Information for California Residents
California law requires businesses to disclose information regarding the rights of California residents pursuant to the California Consumer Protection Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”) (collectively, “CCPA”). Any terms defined in the CCPA (Cal. Civ. Code Sections 1798.100-1798.199.100) have the same meaning when used in this section. California residents may make the following requests with respect to Personal Information in accordance with applicable law:
- Right to Know
You may request that we disclose to you the following information:- The categories of Personal Information we have collected about you;
- The categories of sources from which the Personal Information was collected;
- The business or commercial purpose for collecting, sharing, or selling Personal Information;
- The categories of third parties with whom we share Personal Information;
- The categories of Personal Information about you that we have shared or sold and the categories of third parties to which the Personal Information was shared or sold;
- The categories of Personal Information about you that we have disclosed for a business purpose and the categories of third parties to which the Personal Information was disclosed;
- The specific pieces of Personal Information we have collected about you.
- Right to Portability
You have the right to request that we provide a copy of the Personal Information we collected about you, in a portable and, to the extent technically feasible, readily usable format that allows transmittal of the data to another entity without hindrance. Once we receive such a request and confirm your identity, we will provide you with a copy of your data as required under the CCPA. We may provide this data via email to the email address provided by you. If you refuse to provide an email address, we will provide this information through other methods of contact which you have given us. - Right to Limit Use and Disclosure of Sensitive Personal Information
You have the right to request that we limit the use of your “Sensitive Personal Information” (as defined under the CCPA) to use that is only necessary to perform the services or provide the goods reasonably expected by you. - Right to Delete
You have the right to request that we delete any Personal Information about and collected from you, and that we direct any service provider to whom we have provided such information to delete such Personal Information from its records. Pursuant to the CCPA, however, your Personal Information may not be deleted under certain limited circumstances. Subject to certain exceptions, you have the right to request that we correct inaccurate Personal Information that we collected pertaining to you. Once we receive your request and confirm your identity, we will review the request, considering the nature of the Personal Information and the purposes of the processing of the Personal Information to see if we can correct the data. We may also request additional information to show that the information pertaining to the correction inquiry is inaccurate. - Right to Opt Out of the Sale or Sharing of your Personal Information. You have the right to opt out of the sale of your personal information and to opt out of the sharing of your information for purposes of cross-context behavioural advertising. - Non-Discrimination
We will not discriminate against you because you exercised your rights under the CCPA by:- Denying goods or services to you;
- Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
- Providing a different level or quality of goods or services to you; or
- Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.
Exercising Your Rights
You may make any of the requests listed above by using one of the following methods: (1) submit a request to privacy@exaktera.com; or (2) fill out the form by clicking on the “Your Privacy Choices” link at the bottom of Our Site. Pursuant to California law, we may ask to verify or authenticate your identity before complying with any such request, which may include confirmation of your name, email address, and other information. Such additional information will be used only for the purpose of verifying your identity and for security or fraud-prevention purposes, and will be deleted as soon as practicable after processing your request.
Use of Sensitive Personal Information
We only use your Sensitive Personal Information (Account Logins) for the specific purpose of providing you with access to our Customer Portal. We do not use or disclose this information for any other purpose that would require an opt-out under California law.
